High Court Denies Injunction Request in Alfa Nero Sale Dispute

High Court Judge Rene Williams denied Yulia Gurieva-Motlokhov’s request for an injunction to halt the sale of the Alfa Nero.

The judge ruled that her legal team failed to prove the Antigua and Barbuda Port Authority’s actions were unlawful when they seized the vessel on behalf of the state.

Gurieva-Motlokhov contested the Port Authority (Amendment) Act 2023, which allowed the government to seize the yacht due to environmental concerns in Falmouth Harbour.

However, the judge refused the injunction citing ongoing environmental risks and set the claim of ownership for September 20, 2024. Another related case, ‘Flying Dutchman Overseas Ltd v The Port Authority,’ is also scheduled for that date.

This case involves challenges to the vessel’s seizure by Flying Dutchman Overseas Limited and Vita Felice Limited, both companies incorporated in the British Virgin Islands and managed by Opus Private Ltd.
