Jahciba Shoy Granted Bail Pending Crown Appeal

Jahciba Shoy has been released on $10,000 bail after the prosecution signalled its intention to appeal the High Court’s dismissal of the murder case against him.

The High Court granted Shoy bail on Tuesday with two sureties and no cash deposit required. Although the murder charge was dismissed last week, he remained in custody after prosecutors immediately filed a notice of appeal, delaying his release while allowing him to apply for bail.

The trial judge upheld a no-case submission by defence attorney Wendel Alexander, who argued that the prosecution’s evidence amounted to suspicion and speculation and was insufficient to support a conviction. The judge agreed, ruling that the Crown had failed to establish a case for Shoy to answer.

Shoy had been charged in connection with the May 2023 fatal shooting of 25-year-old Syrian national Roudi Shmaly during an armed robbery at Pick ’n Mix Mart on DeSouza Road.

The Court of Appeal will now decide whether the High Court was correct to dismiss the case or whether further proceedings should follow.
