High Court of Montserrat Orders Immediate Issuance of Practising Certificate to Attorney Warren Cassell

Montserrat – July 29, 2026 – The High Court of Montserrat has ordered the Registrar of Montserrat to issue a practising certificate to attorney-at-law Mr. Warren Cassell forthwith and without any conditions attached.

Under the Legal Profession Act, attorneys are required to apply annually to the Registrar for a practising certificate, which expires on 31 December each year. Mr. Cassell submitted his application in January 2026 in the usual manner. The Registrar refused the application on the grounds of outstanding money judgments and reliance on section 24(2)(i) of the Legal Profession Act, which requires an application to the court where an attorney has not held a practising certificate for more than 12 months.

Mr. Cassell had satisfied all outstanding money judgments prior to making his application. Nonetheless, the Attorney-General objected to the issuance of the certificate, citing, among other things, a pending appeal to the Privy Council.

Through his counsel, Kenny Kentish KC, Mr. Cassell maintained that there was no legal basis upon which the practising certificate could properly be refused. At the hearing, the Attorney-General sought the imposition of conditions on any certificate that might be granted. The Court rejected that request and ordered that the practising certificate be issued to Mr. Cassell without conditions.

This is the second successive success for Mr. Cassell on this issue. In April 2026, the High Court in Antigua and Barbuda similarly ordered the Antigua Registrar to issue him a practising certificate for Antigua and Barbuda after comparable opposition to his application.
